Implementation of Extended DACA

On February 18 the Department of Homeland Security will Start Accepting Applications for Extended DACA.

The Department of Homeland Security has announced that on February 18 it will start accepting applications for Deferred Action for Childhood Arrivals extended program, announced by President Obama on November 20, 2014. Under this Program, people who met all the requirements of DACA, but who did not qualify because they were over the age of 31, will be able to apply for benefits under the program.  These persons will be able to apply if they meet all the other requirements, which are:

1. Have arrived to the United States before the age of 16,
2. Have resided continuously in the United States at least since January 1, 2010,
3. Have been present in the United States on June 15, 2012,
4. Have entered without inspection before June 15, 2012, or have an immigration status that expired before June 15, 2012,
5. Be currently enrolled in school, or have graduated from high school, obtained a GED, or be a veteran honorably discharged from the United States Armed Forces or the Coast Guard, and
6. Not to have any felonies, serious misdemeanors, or more that three misdemeanors, and not to present a danger to the national security of the United States.

With respect to the implementation of DAPA, for persons who arrived in the United States by January 1, 2010 and who have sons or daughters who are United States citizens or permanent residents, the Department of Homeland Security has announced that the program will be implemented prior to May 18, 2015 .  For now, people who think they may qualify for the program should gather documentation showing that they were in the United States at least since January 1, 2010, obtain birth certificates of children, and if they ever have been arrested, must also obtain police reports and final court dispositions for those arrests.

El 18 de Febrero se Empezaran a Aceptar Aplicaciones bajo el Plan Extendido de DACA.

El Departamento de Seguridad Nacional ha anunciado que el 18 de Febrero empezara a aceptar aplicaciones para el plan de Acción Diferida extendido anunciado por el presidente Obama el 20 de Noviembre de 2014.  Bajo este plan se podrán beneficiar personas que cumplían con todos los requisitos del DACA, pero que no calificaban ya que habían cumplido los 31 años de edad.  Estas personas podrán aplicar para el DACA si cumplen los demás requisitos, que son: 

1. Haber llegado a los Estados Unidos antes de cumplir los 16 años,
2. Haber residido en los Estados Unidos por lo menos desde el primero de Enero del 2010,
3. Haber estado presente en los Estados Unidos el 15 de Junio de 2012,
4. Haber entrado sin ser inspeccionado antes del 15 de Junio de 2012, o su estatus legal haber caducado antes del 15 de Junio de 2012,
5. Estar actualmente en la escuela, haberse graduado de la secundaria, haber obtenido un certificado de GED, o ser veteranos separados honorablemente de las Fuerzas Armadas de los Estados Unidos o el Guarda Costa, y
6. No haber cometido una felonia, un misdemeanor grave, o mas de 3 misdemeanors, y no representar un peligro para los Estados Unidos.

Con respecto a la implementación del DAPA, para personas que llegaron antes del primero de Enero del 2010 y que tienen hijos que son ciudadanos Americanos o residentes permanentes, el Departamento de Seguridad Nacional ha anunciado que antes del 18 de Mayo el programa debe haber sido implementado.  Por ahora las personas que piensan que califican para este programa deben empezar a obtener documentación que pruebe que han estado en los Estados Unidos por lo menos desde Enero 1, 2010, obtener registros de nacimiento de sus hijos, y si alguna vez han sido arrestados, obtener una copia completa de los reportes del arresto y dispocisiones finales de la corte.
